Tell Your Legislator - STOP HB 2706!

Arizona House Republicans continued their attack on transgender student athletes. On a party line vote, House Republicans passed an egregious anti-transgender bill, HB 2706. This is not the end and we can stop this bill right now, but your Senator needs to hear from you!

If passed by the Senate, the bill would ban transgender athletes from participating on K-12 and college sports teams corresponding to their gender identity.

HB 2706 is an invasive, impractical solution to a problem that does not exist. On top of being impossible to enforce, a transgender youth may not be out to their peers, teachers, or potential coach as transgender. In that case, Arizona schools would be put in the position of outing the child - to the coach, athletic association, teammates, and their parents - which the school is not legally or ethically authorized to do under medical privacy laws, professionalism standards, and other regulations.

Dear Senator,

As a resident of Arizona and a supporter of the Human Rights Campaign, I am writing with grave concern about House Bill 2706. If passed, this bill would ban transgender athletes from participating on K-12 and college sports teams corresponding to their gender identity. It is a solution to a problem that does not exist, and we cannot go back to the days of SB 1062, an anti-LGBTQ bill which was ultimately vetoed by Governor Brewer after national outcry.

Transgender students, like all students, can benefit from being part of sports, and allowing them to participate in athletic activities consistent with their gender identity in no way disadvantages their fellow students. Transgender girls are girls, transgender women are women, and transgender boys and men are boys and men. Attempting to separate transgender youth from their peers is impractical, unfair, and unnecessary.

This bill offers an invasive, impractical approach to separating transgender students from their peers that is as unwieldy as it is unnecessary. The idea that a youth should be subjected to invasive examination, testing, and analysis – which is unscientific and contrary to medical best practice – is repugnant. Should a transgender youth not be out as such to their peers, teachers, or potential coach, the school would be in the position of having to violate the youth’s medical privacy and outing the youth to the coach, athletic association, teammates, and parents, in contravention of medical privacy laws, professional standards, and other regulations.
Not only is this bill a solution in search of a problem, it isn’t even a solution – it is just a problem.
