The Ohio Department of Mental Health and Addiction Services needs to hear from you this week. At the direction of Governor Mike DeWine, the Department has proposed regulations that would add draconian new hurdles for transgender people — of any age — who attempt to access health care related to their transition anywhere in the state. These regulations would create onerous requirements targeting transition-related care that will eliminate available resources. They would even require that hospitals create detailed plans for detransitioning patients to be allowed to diagnose gender dysphoria or provide transition-related care at all.

Decisions about a young person’s health care should be made by the young person’s parents in consultation with their doctor according to guidelines set by doctors, not politicians.

I’m writing to strongly oppose regulations recently proposed by the Department of Mental Health and Addiction Services that would unnecessarily and discriminatorily impact the ability of transgender people to access medically necessary health care.

Every credible medical organization — representing over 1.3 million doctors in the United States — supports gender-affirming care for transgender and non-binary people. However, the Department’s proposal would add onerous requirements that will reduce available resources for this type of care even though it can be lifesaving. Parents and doctors should be empowered to do everything they can to make all youth, including transgender youth, feel loved and accepted, but the Department’s regulations will make that harder for them to do.

Medical professionals, not politicians, should be the people advising parents and transgender adults about what kind of care is appropriate for their situation. Hospitals and doctors across our state already work to ensure health care is delivered to transgender people in an age-appropriate manner and in consultation with medical and mental health professionals AND parents. These hospitals should not be required to create detailed plans for detransitioning patients — something which happens extremely rarely and which would create an enormous administrative burden for the hospitals — but the Department’s proposal would call for this and other unnecessary and harmful requirements to be followed for them to be allowed to diagnose gender dysphoria or provide transition-related care at all.

I urge the Department to quickly rescind these proposed regulations in their entirety.
